He Lied...and So Many Do!
I am referring to the recent news involving the Bernie Fine case and that his very convincing accuser has decided to "truth up" and tell the world that all his allegations and statements were lies. The sad thing is that a bunch of highly qualified investigators, prosecutors couldn't detect the truth and simply became entranced with the allegation instead of the truth. And as one might already suspect, Bernie Fine is destroyed beyond recognition, his career destroyed; and all that any of these people will have to say is "we followed the evidence and the law" so we didn't really do anything wrong; or in more understandable terms "oops, our bad have a nice day"!
What is bothersome to me is that upon hearing these allegations being brought against Mr. Fine, the general public doesn't care or is concerned about the lack of evidence or question the credibility of the accuser for one minute. People get caught up in the hype and the disgusting images that surround allegations of sexual abuse. They don't seem need anything more than an allegation to set their thoughts at throwing Mr. Fine away forever because he has been portrayed as a monster, but not proven to be one. It doesn't seem to matter if his rights, his career and his family are so easily destroyed by words alone, because isn't this more about how they feel about this horrible allegations rather than the facts or the truth? But now that the truth comes out, how does this reverse all the collateral damage already done? It doesn't and likely nobody is concerned that it won't.
Every day in this country, men (primarily) are falsely accused of sex related crimes. Every day the media pumps up the hype and portrays these individuals as monsters and threats to society. And what is even more heinous than the allegation itself, is that unlike any other crime, allegations of sexual abuse require no evidence, no DNA, no witnesses, no written statements; just the word of the accuser against the accused. Oh yes, that is the truth and fact of the matter. If you don't think I'm right, then why did people believe Bernie Fine was guilty? Was it the overwhelming evidence that corroborated the allegations against him? Was it simply because investigators and prosecutors said they had proof? But if everything was a lie, then how can there be facts or evidence to be found against him? You would have thought the public would have woke up after the Duke Lacrosse cases, where millions of dollars were spent to defend these innocent men against their accuser's false allegations, had their lives and freedom placed into jeopardy, only to have her come forward and admit everything was a lie. These guys could have spent the rest of their lives behind bars if they didn't have the financial resources for million dollar defense teams or if she never came forward and told the truth. The average American doesn't have these resources and generally are convinced to take pleas because the mere allegation is too risky to defend at a jury trial, where quite frankly, the jury consists of a naive public, that's biased, fearful and prejudiced. Who simply wants this all to go away so they can be more peaceful in their own life and conscience by making a better safe than sorry decision to convict on emotions rather than to acquit on the lack of evidence.
Don't get me wrong, there are a lot of horrible monsters out there that do commit violent acts of abuse. And you will find that these cases have some physical evidence to support the crime that they are accused of. I have found that it is far more likely that a man will be acquitted of murder unless there is enough physical corroborating evidence linking him to the crime than a man who is falsely accused of sexual abuse where the only "evidence" against him is the word of his accuser. Prosecutors love sex cases because they can generally always win by either a plea or by a prejudiced jury trial, even when no evidence exists and is impossible to exist because the allegation is false. Defense attorneys understand the immediate uphill risk of these types of cases and that there is usually no presumption of innocence because people simply can't understand why anyone would lie about such a horrible thing. Society loves victims and has become entrenched in the victimology through the media and television that when they become confronted with evaluating a situation or a case themselves, they are unable to erase their preconceived images of the alleged victim and they are unable to hear or see the lack of fact being brought before them. Their fears and prejudice override their objectivity and their ability to weigh the situation solely on the facts and the lack of physical or forensic evidence. Again, when the allegation is false, there cannot be physical or forensic evidence that reinforces the word alone of an alleged victim that claims it is so.
Why is all this so important to understand? Because there are countless stories like these where innocent men and women are imprisoned and registered for life for crimes of sexual abuse they did not commit. No only are these men and women permanently scarred for life, but their loving families are torn apart and their own children become the real victims from this separation brought upon them by ruthless prosecutors and courts that choose to win cases rather than to seek the truth. I just don't understand why these children and these families are not seen as true victims and no one seems to have any compassion for them!
I want to end this by sharing a story that was recently shared with me. It is a real story of false allegations against a man, his family's fight and a horrible heart wrenching turn of events. If you don't think this stuff is real enough to be concerned about, read this story. If you think for one minute that false allegations don't happen to good people, then you might not be really paying attention to the world around us; because it is closing in and likely someone you know is only an ugly allegation away from having their lives turned upside down and forever changed!
