The 23% response rate is interesting. I am also curious about the 77% that didn't respond out of the 10,000 surveyed? Did they refuse to respond or comment? Was the subject of the survey just too sensitive to talk about? Is 23% a good statistical expectation on a survey of this type? I don't really know but the results based on those that did respond should open your eyes!
One of the comments related to a "lawyer feeding frenzy". Really I'm not so sure this is not so far from part of the problem in these cases. The issue is that with a true false allegation case, there is no evidence and the only things the prosecutor's have to hang their hats on are the alleged victim's words, and in the cases involving children, the corroborating words of a vindictive parent or adult. Couple this with the natural prejudice and bias surrounding any allegation of sexual abuse; and you have a potentially fatal chance at a jury trial.
Now some greedy lawyers that truly understand this dynamic will charge large fees and play the court appearance game and set their client up for the plea. Sure they know their client has been falsely accused, but they also know from experience that the prosecutors, investigators and the courts are well tuned to stack the charges, submit unprovable timelines and understand the pure emotional value of typical juries and their need to do "what feels right" to protect the alleged victim; not an examination of evidence (or the lack of); the burden of proof or any presumption of innocence. They know going in that this is an uphill battle for the accused and that if it goes to trial and is lost, that prison time will certainly be maxed out for furthering the victimization of the alleged victim; not because you exercised your right to remain innocent and exercise your right to a jury trial.
From the falsely accused's perspective, you are faced with either taking a plea to avoid excessive prison time and registry issues or taking your chances at trial. What do you do? Plead guilty to avoid prison time for something you didn't do? Of course not! But wait...what if I lose at trial and get wrongfully convicted? I mean there is no evidence right? The jury will see that this is just a bunch of lies right? They all know kids lie and that false memories can be implanted, right? The jury will understand that these tears are not real and the story doesn't make sense right? WRONG! You can't trust that any of this will protect your innocence. Watch the news, read the papers; thousands of false allegation cases are occurring across this country and innocent people are being wrongfully convicted everyday.
False allegations are destroying innocent lives and tearing good families apart, victimizing both children and adults alike. CPS, Investigators and Prosecutors only see guilt and victimization and care little about actual evidence, the motive of the accuser(s) or any probability of actual innocence. It's more about closing and winning cases and the public perception of perceived justice; not the truth. My fear is the the 77% of those who didn't respond to this survey, are those whom sit on our juries, full of prejudice and bias, and are not willing to stand up for the truth and demand that if there is no physical corroborating evidence and only the word of one against another; that it IS their duty to protect the innocence of the falsely accused instead of just becoming one of the flock that leads the innocent to the slaughterhouse because it makes them feel like they had to do the right thing because people just simply don't make this kind of stuff up. It's no wonder they refer to it as "Courtroom Drama"!
